Im vorliegenden Fall aber sind die Voraussetzungen für die Anwendung dieser Ausnahmebestimmung nicht gegeben.

1.7 Dass diese Ausnahmebestimmung oder Reparaturklausel vorgesehen wurde, kam den Forderungen bestimmter Industriezweige entgegen, die Autoersatzteile nachbauen, insbesondere sog. "crash parts" (bei Unfällen häufig beschädigte Blechteile). Diese "unabhängigen Lieferanten" hatten schon versucht, aufgrund der geltenden Rechtslage eine Ausnahme vom Schutz von Mustern und Modellen zu erreichen, und sich an den EuGH gewandt, jedoch ohne Erfolg (siehe den Fall CICRA gegen Renault [2] und den Fall Volvo gegen Veng [3]).

Im vorliegenden Fall ist es aber nicht so gravierend, dass der Richter unter Umständen beide Rechte evaluieren muss, weil es ja hier um eine Ausnahmebestimmung geht. Wenn man schon eine Ausnahme macht, ist es sicher richtig, dass man sie nur dann macht, wenn auch ein besseres Resultat herauskommt, und sicher dann nicht, wenn das Resultat schlechter wird. Ergänzungsantrag von Herrn X mit der Ergänzung "sachgerecht" abgelehnt.
