Waren der Kapitel 50 bis 55 oder der Positionen 5809 oder 5902 , die aus zwei oder mehr Spinnstoffen bestehen , sind so einzureihen , als bestaenden sie ganz aus dem Spinnstoff , der dem Gewicht nach gegenueber jedem anderen Spinnstoff vorherrscht . Wenn kein Spinnstoff dem Gewicht nach vorherrscht , sind die Waren so einzureihen , als bestaenden sie ganz aus dem Spinnstoff , der zu der von den gleichermassen in Betracht kommenden Positionen in dieser Nomenklatur zuletzt genannten Position gehoert . B. Fuer die Anwendung dieser Regel gilt : a ) umsponnene Garne aus Rosshaar ( Position 5110 ) und Metallgarne und metallisierte Garne ( Position 5605 ) gelten mit ihrem Gesamtgewicht als Garne aus einem einheitlichen Spinnstoff ; Metallfaeden , die in Geweben enthalten sind , gelten fuer die Einreihung dieser Waren als Garne aus Spinnstoffen ; b ) die Wahl der zutreffenden Position hat in der Weise zu erfolgen , dass zuerst das Kapitel und danach innerhalb dieses Kapitels die anzuwendende Position ermittelt wird , wobei alle Spinnstoffe , die nicht zu diesem Kapitel gehoeren , ausser Betracht bleiben ; c ) wenn die beiden Kapitel 54 und 55 und ein anderes Kapitel in Betracht kommen , so sind die Kapitel 54 und 55 wie ein einziges Kapitel zu behandeln ; d ) wenn in einem Kapitel oder in einer Position mehrere Spinnstoffe erfasst sind , werden diese als ein einheitlicher Spinnstoff behandelt . C. Die Bestimmungen der Absaetze A und B sind auch auf die in den nachstehenden Anmerkungen 3 , 4 , 5 und 6 aufgefuehrten Garne anzuwenden . 3. A. Als _DOUBLEQUOTE_ Bindfaeden , Seile und Taue _DOUBLEQUOTE_ gelten im Abschnitt XI , vorbehaltlich der im nachstehenden Absatz B enthaltenen Ausnahmen , Garne ( ungezwirnt oder gezwirnt ) : a ) aus Seide , Schappeseide oder Bourretteseide , mit einem Titer von mehr als 20 000 dtex ; b ) aus Chemiefasern ( einschliesslich solcher Garne , die aus zwei oder mehr Monofilen des Kapitels 54 hergestellt sind ) , mit einem Titer von mehr als 10 000 dtex ; c ) aus Hanf oder Flachs : 1 ) poliert oder glasiert , mit einem Titer von 1 429 dtex oder mehr ; 2 ) weder poliert noch glasiert , mit einem Titer von mehr als 20 000 dtex ; d ) aus Kokosfasern , drei- oder mehrdraehtig ; e ) aus anderen pflanzlichen Fasern , mit einem Titer von mehr als 20 000 dtex ; f ) mit Metalldraht verstaerkt . B. Als _DOUBLEQUOTE_ Bindfaeden , Seile und Taue _DOUBLEQUOTE_ gelten nicht : a ) Garne aus Wolle , feinen oder groben Tierhaaren oder aus Rosshaar und Papiergarne , alle diese , wenn sie nicht mit Metalldraht verstaerkt sind ; b ) Kabel aus synthetischen oder kuenstlichen Filamenten in Form von Kabeln des Kapitels 55 und Garne aus Multifilamenten ohne Drehung oder mit weniger als 5 Drehungen je Meter , des Kapitels 54 ; c ) Messinahaar der Position 5006 und Monofile des Kapitels 54 ; d ) Metallgarne und metallisierte Garne der Position 5605 ; Garne aus Spinnstoffen , mit Metalldraht verstaerkt , werden gemaess vorstehendem Absatz A Buchstabe f ) eingereiht ; e ) Chenillegarne , Gimpen und _DOUBLEQUOTE_ Maschengarne _DOUBLEQUOTE_ der Position 5606 . 4. A. Als _DOUBLEQUOTE_ Garne in Aufmachungen fuer den Einzelverkauf _DOUBLEQUOTE_ gelten in den Kapiteln 50 , 51 , 52 , 54 und 55 , vorbehaltlich der im nachstehenden Absatz B enthaltenen Ausnahmen , Garne ( ungezwirnt oder gezwirnt ) , die aufgemacht sind : a ) auf Karten , Spulen , Huelsen oder aehnlichen Unterlagen , sofern das Gewicht ( einschliesslich Unterlage ) je Stueck nicht mehr betraegt als : 1 ) 85 g bei Garnen aus Seide , Schappeseide oder Bourretteseide oder aus synthetischen oder kuenstlichen Filamenten ; 2 ) 125 g bei anderen Garnen ; b ) in Kugeln , Knaeueln oder im Strang , sofern das Gewicht je Stueck nicht mehr betraegt als : 1 ) 85 g bei Garnen aus synthetischen oder kuenstlichen Filamenten mit einem Titer von weniger als 3 000 dtex , oder aus Seide , Schappeseide oder Bourretteseide ; 2 ) 125 g bei anderen Garnen , mit einem Titer von weniger als 2 000 dtex ; 3 ) 500 g bei anderen Garnen ; c ) im Strang , sofern der Strang durch einen oder mehrere Fitzfaeden in gewichtsmaessig gleiche , abtrennbare Teilstraenge unterteilt ist und das Gewicht je Teilstrang nicht mehr betraegt als : 1 ) 85 g bei Garnen aus Seide , Schappeseide oder Bourretteseide oder aus synthetischen oder kuenstlichen Filamenten ; 2 ) 125 g bei anderen Garnen . B. Als _DOUBLEQUOTE_ Garne in Aufmachungen fuer den Einzelverkauf _DOUBLEQUOTE_ gelten nicht : a ) ungezwirnte Garne aus Spinnstoffen aller Art , ausgenommen : 1 ) ungezwirnte rohe Garne aus Wolle oder feinen Tierhaaren ; 2 ) ungezwirnte Garne aus Wolle oder feinen Tierhaaren , gebleicht , gefaerbt oder bedruckt , mit einem Titer von mehr als 5 000 dtex ; b ) gezwirnte Garne , roh : 1 ) aus Seide , Schappeseide oder Bourretteseide , in Aufmachungen aller Art ; 2 ) aus anderen Spinnstoffen ( ausgenommen Wolle und feine Tierhaare ) , im Strang ; c ) gezwirnte Garne , gebleicht , gefaerbt oder bedruckt , aus Seide , Schappeseide oder Bourretteseide , mit einem Titer von 133 dtex oder weniger ; d ) Garne aus Spinnstoffen aller Art , ungezwirnt oder gezwirnt , die aufgemacht sind : 1 ) im Strang mit Kreuzhaspelung ; 2 ) auf Unterlagen oder in anderen Aufmachungen , die ihre Verwendung in der Textilindustrie anzeigen ( z.B. auf Zwirnmaschinenspulen , Kanetten ( Kopsen ) , konischen Spulen oder Konen oder in Wickel fuer Stickmaschinen ) . 5. Als _DOUBLEQUOTE_ Naehgarne _DOUBLEQUOTE_ im Sinne der Positionen 5204 , 5401 und 5508 gelten gezwirnte Garne , die allen nachstehenden Bedingungen entsprechen : a ) auf Unterlagen ( z.B. Rollen , Spulen ) aufgemacht und mit einem Gewicht , einschliesslich Unterlage , von nicht mehr als 1 000 g ; b ) appretiert ; c ) mit einer Z-Drehung als letzter Drehung . 6. Als _DOUBLEQUOTE_ hochfeste Garne _DOUBLEQUOTE_ im Sinne des Abschnitts XI gelten Garne , deren Festigkeit , ausgedrueckt in cN / tex ( centinewton je tex ) , die nachstehenden Grenzwerte ueberschreitet : - ungezwirnte Garne aus Nylon oder anderen Polyamiden oder aus Polyestern : 60 cN / tex , - gezwirnte Garne aus Nylon oder anderen Polyamiden oder aus Polyestern : 53 cN / tex , - ungezwirnte oder gezwirnte Garne aus Viskose : 27 cN / tex . 7. Als _DOUBLEQUOTE_ konfektioniert _DOUBLEQUOTE_ im Sinne des Abschnitts XI gelten : a ) Waren in anderer als quadratischer oder rechteckiger Form zugeschnitten ; b ) Waren , die abgepasst hergestellt und gebrauchsfertig sind oder durch blosses Zerschneiden der nicht gebundenen Faeden ohne Naehen oder eine andere zusaetzliche Arbeit gebrauchsfertig werden ( z.B. Putztuecher , Handtuecher , Tischtuecher , Halstuecher und Decken ) ; c ) Waren , deren Raender entweder durch Saeume aller Art , auch Rollsaeume , oder durch geknuepfte Fransen aus den Faeden der Waren selbst oder aus nachtraeglich angebrachten Faeden befestigt sind ; Meterwaren , deren Schnittkanten wegen des Fehlens eines festen Randes in einfacher Weise gegen Ausriefeln gesichert sind , gelten nicht als konfektioniert ; d ) Waren , beliebig zugeschnitten , mit Auszieharbeit ; e ) Waren , durch Naehen , Kleben oder in anderer Weise zusammengefuegt , ausgenommen Meterwaren , die aus zwei oder mehr Stuecken des gleichen Spinnstofferzeugnisses bestehen , die an ihren Enden zu einem Stueck von groesserer Laenge vereinigt sind , und Meterwaren , die aus zwei oder mehr mit ihrer ganzen Flaeche aufeinanderliegenden und so miteinander verbundenen Spinnstofferzeugnissen bestehen , auch mit Zwischenlagen aus einem Polsterfuellstoff ; f ) Waren , abgepasst gewirkt oder abgepasst gestrickt , als Meterware , mehrere Einheiten umfassend . 8. Konfektionierte Waren im Sinne der Anmerkung 7 gehoeren weder zu den Kapiteln 50 bis 55 , noch , soweit nichts anderes bestimmt ist , zu den Kapiteln 56 bis 60. Zu den Kapiteln 50 bis 55 gehoeren nicht Waren , die in den Kapiteln 56 bis 59 erfasst sind . 9. Den Geweben der Kapitel 50 bis 55 werden Erzeugnisse gleichgestellt , die aus Lagen parallel gelegter Spinnstoffgarne bestehen und bei denen die Lagen im spitzen oder rechten Winkel uebereinanderliegen . Diese Lagen sind an den Beruehrungspunkten der Garne durch ein Bindemittel verklebt oder verschweisst . 10. Elastische Erzeugnisse aus Spinnstoffwaren in Verbindung mit Kautschukfaeden , gehoeren zu Abschnitt XI. 11. Im Abschnitt XI gilt als _DOUBLEQUOTE_ getraenkt _DOUBLEQUOTE_ auch _DOUBLEQUOTE_ getaucht _DOUBLEQUOTE_ ( _DOUBLEQUOTE_ gedippt _DOUBLEQUOTE_ ) . 12. Im Abschnitt XI gelten als _DOUBLEQUOTE_ Polyamide _DOUBLEQUOTE_ auch _DOUBLEQUOTE_ Aramide _DOUBLEQUOTE_ . 13. Soweit nichts anderes bestimmt ist , werden Kleidungsstuecke aus Spinnstoff , die zu verschiedenen Positionen gehoeren , auch dann getrennt in diese Positionen eingereiht , wenn sie als Warenzusammenstellungen fuer den Einzelverkauf aufgemacht sind . Unterpositions-Anmerkungen 1. Im Abschnitt XI und in allen anderen Teilen der Nomenklatur gelten als : a ) Elastomergarne : Garne aus Filamenten ( einschliesslich Monofile ) aus synthetischen Spinnstoffen , andere als texturierte Garne , die , ohne zu reissen , eine Dehnung bis zum Dreifachen ihrer urspruenglichen Laenge aushalten und die sich , wenn sie bis zum Doppelten ihrer urspruenglichen Laenge gedehnt worden sind , innerhalb von 5 Minuten mindestens auf das Eineinhalbfache ihrer urspruenglichen Laenge zusammenziehen. b ) rohe Garne : 1 ) Garne , die die natuerliche Farbe ihrer Fasern aufweisen und weder gebleicht noch gefaerbt ( auch nicht in der Masse ) noch bedruckt sind oder 2 ) Garne , die von unbestimmter Farbe aus Reissspinnstoffen hergestellt sind ( _DOUBLEQUOTE_ Grau-Garne _DOUBLEQUOTE_ ) . Diese Garne koennen farblos appretiert oder fluechtig gefaerbt ( die Anfaerbung laesst sich durch blosses Waschen mit Seife entfernen ) und , im Falle der Garne aus Chemiefasern , in der Masse mit Mattierungsstoffen ( z.B. Titandioxid ) behandelt sein. c ) gebleichte Garne : 1 ) Garne , die einen Bleichprozess erfahren haben oder aus gebleichten Fasern hergestellt sind , oder , sofern nicht anderes bestimmt ist , weiss gefaerbt sind ( auch in der Masse ) oder weiss appretiert sind oder 2 ) Garne , die aus einer Mischung von rohen und gebleichten Fasern bestehen oder 3 ) Garne , die gezwirnt sind und aus rohen und gebleichten Garnen bestehen. d ) farbige Garne ( gefaerbt oder bedruckt ) : 1 ) Garne die ( auch in der Masse ) anders als weiss oder fluechtig gefaerbt sind oder bedruckt oder aus gefaerbten oder bedruckten Fasern hergestellt sind oder 2 ) Garne , die aus einer Mischung von verschieden gefaerbten Fasern oder einer Mischung von rohen oder gebleichten Fasern und farbigen Fasern bestehen ( Jaspé-Garne oder melierte Garne ) , oder in Abstaenden mit einer oder mehreren Farben bedruckt sind in der Weise , dass eine Art Punktierung entsteht oder 3 ) Garne , deren Vorgarn oder Lunte bedruckt worden ist oder 4 ) Garne , die gezwirnt sind und aus rohen oder gebleichten Garnen und aus farbigen Garnen bestehen . Die vorstehenden Bestimmungen gelten sinngemaess auch fuer Monofile , Streifen und dergleichen des Kapitels 54. e ) rohe Gewebe : Gewebe , die aus rohen Garnen hergestellt und weder gebleicht noch gefaerbt noch bedruckt sind . Diese Gewebe koennen farblos appretiert oder fluechtig gefaerbt sein. f ) gebleichte Gewebe : 1 ) Gewebe , die im Stueck gebleicht oder , wenn nichts anderes bestimmt ist , weiss gefaerbt oder weiss appretiert sind oder 2 ) Gewebe , die aus gebleichten Garnen bestehen oder 3 ) Gewebe , die aus rohen Garnen und gebleichten Garnen bestehen. g ) gefaerbte Gewebe : 1 ) Gewebe , die im Stueck in einer einzigen einheitlichen Farbe , anders als weiss ( wenn nichts anderes bestimmt ist ) , gefaerbt sind oder farbig appretiert sind , anders als weiss ( wenn nichts anderes bestimmt ist ) oder 2 ) Gewebe , die aus farbigen Garnen mit einer einzigen einheitlichen Farbe bestehen. h ) buntgewebte Gewebe : Gewebe ( andere als bedruckte Gewebe ) : 1 ) die aus verschiedenfarbigen Garnen oder aus Garnen mit verschiedenen Schattierungen der gleichen Farbe ( einer anderen als der natuerlichen Farbe der verwendeten Fasern ) bestehen oder 2 ) die aus rohen oder gebleichten Garnen und farbigen Garnen bestehen oder 3 ) die aus Jaspé-Garnen oder melierten Garnen bestehen . ( Garne , die die Webkante bilden oder aus denen die Stueckenden bestehen , bleiben ausser Betracht ) . ij ) bedruckte Gewebe : Gewebe , die im Stueck bedruckt sind , auch wenn sie aus verschiedenfarbigen Garnen bestehen . Den bedruckten Geweben werden Gewebe gleichgestellt , die Muster aufweisen , die z.B. mit Pinsel , Buerste , Spritzpistole , Transferpapier , durch Beflocken , oder in einem Batikverfahren hergestellt sind . Bei Anwendung der vorstehenden Bestimmungen bleibt das Mercerisieren ohne Einfluss auf die Einreihung der Garne und Gewebe. k ) Leinwandbindung : eine Gewebebindung , in der jeder Schussfaden abwechselnd oberhalb und unterhalb der aufeinanderfolgenden Kettfaeden und jeder Kettfaden abwechselnd oberhalb und unterhalb der aufeinanderfolgenden Schussfaeden verlaeuft . 2. A. Waren der Kapitel 56 bis 63 , die aus zwei oder mehr Spinnstoffen bestehen , sind so zu behandeln , als bestaenden sie ganz aus dem Spinnstoff , der nach der Anmerkung 2 zu Abschnitt XI ermittelt werden muesste bei der Einreihung einer aus den gleichen Spinnstoffen bestehenden Ware der Kapitel 50 bis 55. B. Hierbei ist zu beachten : a ) es ist gegebenenfalls nur der Teil zu beruecksichtigen , der im Sinne der Allgemeinen Vorschrift 3 fuer die Auslegung der Nomenklatur massgebend ist ; b ) bei Spinnstofferzeugnissen aus einem Grund und einer Flor- oder Schlingenoberflaeche bleibt der Grund ausser Betracht ; c ) bei Stickereien der Position 5810 wird nur der Stickgrund beruecksichtigt . Bei Stickereien ohne sichtbaren Stickgrund richtet sich die Einreihung jedoch ausschliesslich nach den Stickfaeden . Zusaetzliche Anmerkung 1. ( B ) Exceptions : ( a ) yarn of wool or other animal hair and paper yarn , other than yarn reinforced with metal thread ; ( b ) man-made filament tow of Chapter 55 and multifilament yarn without twist or with a twist of less than five turns per metre of Chapter 54 ; ( c ) silkworm gut of heading No 5006 , and monofilaments of Chapter 54 ; ( d ) metallized yarn of heading No 5605 ; yarn reinforced with metal thread is subject to paragraph ( A ) ( f ) above ; and ( e ) chenille yarn , gimped yarn and loop wale-yarn of heading No 5606 . 4 . ( A ) For the purposes of Chapters 50 , 51 , 52 , 54 and 55 , the expression 'put up for retail sale ' in relation to yarn means , subject to the exceptions in paragraph ( B ) below , yarn ( single , multiple ( folded ) or cabled ) put up : ( a ) on cards , reels , tubes or similar supports , of a weight ( including support ) not exceeding : ( i ) 85 g in the case of silk , waste silk or man-made filament yarn ; or ( ii ) 125 g in other cases ; ( b ) in balls , hanks or skeins of a weight not exceeding : ( i ) 85 g in the case of man-made filament yarn of less than 3 000 decitex , silk or silk waste ; ( ii ) 125 g in the case of all other yarns of less than 2 000 decitex ; or ( iii ) 500 g in other cases ; ( c ) in hanks or skeins comprising several smaller hanks or skeins separated by dividing threads which render them independent one of the other , each of uniform weight not exceeding : ( i ) 85 g in the case of silk , waste silk or man-made filament yarn ; or ( ii ) 125 g in other cases . ( B ) Exceptions : ( a ) single yarn of any textile material , except : ( i ) single yarn of wool or fine animal hair , unbleached ; and ( ii ) single yarn of wool or fine animal hair , bleached , dyed or printed , measuring more than 5 000 decitex ; ( b ) multiple ( folded ) or cabled yarn , unbleached : ( i ) of silk or waste silk , however put up ; or ( ii ) of other textile material except wool or fine animal hair , in hanks or skeins ; ( c ) multiple ( folded ) or cabled yarn of silk or waste silk , bleached , dyed or printed , measuring 133 decitex or less ; and ( d ) single , multiple ( folded ) or cabled yarn of any textile material : ( i ) in cross-reeled hanks or skeins ; or ( ii ) put up on supports or in some other manner indicating its use in the textile industry ( for example , on cops , twisting mill tubes , pirns , conical bobbins or spindles , or reeled in the form of cocoons for embroidery looms ) . 5 . For the purposes of heading Nos 5204 , 5401 and 5508 , the expression 'sewing thread ' means multiple ( folded ) or cabled yarn : ( a ) put up on supports ( for example , reels , tubes ) of a weight ( including support ) not exceeding 1 000 grams ; ( b ) dressed ; and ( c ) with a final 'Z ' twist . 6 . For the purposes of this section , the expression 'high tenacity yarn ' means yarn having a tenacity , expressed in cN / tex ( centinewtons per tex ) , greater than the following : - single yarn of nylon or other polyamides , or of polyesters : 60 cN / tex , - multiple ( folded ) or cabled yarn of nylon or other polyamides , or of polyesters : 53 cN / tex , - single , multiple ( folded ) or cabled yarn of viscose rayon : 27 cN / tex . 7 . For the purposes of this section , the expression 'made up ' means : ( a ) cut otherwise than into squares or rectangles ; ( b ) produced in the finished state , ready for use ( or merely needing separation by cutting dividing threads ) without sewing or other working ( for example , certain dusters , towels , table cloths , scarf squares , blankets ) ; ( c ) hemmed or with rolled edges , or with a knotted fringe at any of the edges , but excluding fabrics the cut edges of which have been prevented from unravelling by whipping or by other simple means ; ( d ) cut to size and having undergone a process of drawn thread work ; ( e ) assembled by sewing , gumming or otherwise ( other than piece goods consisting of two or more lengths of identical material joined end to end and piece goods composed of two or more textiles assembled in layers , whether or not padded ) ; ( f ) knitted or crocheted to shape , presented in the form of a number of items in the length . 8 . Chapters 50 to 55 and , except where the context otherwise requires , Chapters 56 to 60 , do not apply to goods made up within the meaning of note 7 above . Chapters 50 to 55 do not apply to goods of Chapters 56 to 59 . 9 . The woven fabrics of Chapters 50 to 55 include fabrics consisting of layers of parallel textile yarns superimposed on each other at acute or right angles . These layers are bonded at the intersections of the yarns by adhesive or by thermal bonding . 10 . Elastic products consisting of textile materials combined with rubber threads are classified in this section . 11 . For the purposes of this section , the expression 'impregnated ' includes 'dipped ' . 12 . For the purposes of this section , the expression 'polyamides ' includes 'aramids ' . 13 . Unless the context otherwise requires , textile garments of different headings are to be classified in their own headings even if put up in sets for retail sale . Subheading notes 1 . In this section and , where applicable , throughout the nomenclature , the following expressions have the meanings hereby assigned to them : ( a ) ' Elastomeric yarn ' : Filament yarn , including monofilament , of synthetic textile material , other than textured yarn , which does not break on being extended to three times its original length and which returns , after being extended to twice its original length , within a period of five minutes , to a length not greater than one-and-a-half times its original length .
