Accordingly, the burden of proof must lie with those who seek to extend an implementing regulation and not with those who want to let it expire.

(4) In Anhang 4 der Durchführungsverordnung ist die öffentlich zugängliche Datenbank bezeichnet, in der die Informationen nach Absatz 1 zusammengestellt sind.

(1) Ist der Versicherungsfall vor dem Datum des Inkrafttretens der Durchführungsverordnung im Hoheitsgebiet des betreffenden Mitgliedstaats eingetreten, ohne dass vor diesem Zeitpunkt für den Rentenantrag eine Feststellung erfolgt ist, und sind aufgrund dieses Versicherungsfalls Leistungen für eine Zeitspanne vor diesem Zeitpunkt zu gewähren, so hat dieser Antrag eine doppelte Feststellung zur Folge, und zwar

Where the contingency arises before the date of entry into force of the implementing Regulation in the territory of the Member State concerned and the claim for pension has not been awarded before that date, such claim shall give rise to a double award, in as much as benefits must be granted, pursuant to such contingency, for a period prior to that date:

ii) die im Gesetz und seiner Durchführungsverordnung vorgesehenen tatsächlichen Zahlungen von La Poste werden der auf der angemeldeten Reform beruhenden Entwicklung Rechnung tragen, solange die kapitalisierte Summe der Unterschiedsbeträge zwischen den jährlichen Sozialbeiträgen in Anwendung des TEC unter Berücksichtigung der gemeinsamen Risiken und dem angemeldeten Beitrag (angemeldeter TEC und Beitragszuschlag 2006-2009) unter 2 Mrd.

(ii) the actual payments by La Poste provided for by the Law and its implementing decree will be as indicated in the notified reform for as long as the capitalised sum of the differences between the annual contributions resulting from application of the TEC (with account being taken of the non-common risks) and the contribution notified (TEC notified and surcharges 2006-2009) and effectively paid remains below EUR 2 billion (amount of the exceptional flat-rate contribution).

If it is not possible to recover all or any of the claim via this offsetting procedure, the remainder of the amount due shall be recovered in accordance with Articles 75 to 85 of the implementing Regulation.
