Einspruchsgrund

9. Da somit die in der Einspruchsbegründung geltend gemachten Einspruchsgründe der Aufrechterhaltung des europäischen Patents nicht entgegenstehen (vgl. Artikel 102 EPÜ), kommt es darauf an, ob das Streitpatent im Hinblick auf den von der Einsprechenden erst in ihrer Beschwerdebegründung vorgetragenen Einspruchsgrund der fehlenden Ausführbarkeit der Erfindung i. S. v. Artikel 83 bzw. 100 b) EPÜ zu widerrufen ist.

9. Since therefore the grounds for opposition as filed do not prejudice maintenance of the European patent (cf. Article 102 EPC), the question is whether the contested patent must be revoked on the grounds - only advanced by the opponents in their appeal - that the invention cannot be carried out as required by Articles 83 and 100(b) EPC.
