Es wichtig, daß sämtliche Höchstbeträge im Falle der Haftung des Luftfahrtunternehmens aufgehoben werden und daß bis zu einem Gegenwert von 100 000 Sonderziehungsrechten keine Haftungsfreistellung erfolgt.

It is important to waive the financial limits of liability where an airline is proved to be at fault but to impose a strict level of liability up to the equivalent of 100, 000 special drawing rights.

In dem Bericht ist auch zu untersuchen, ob angesichts der technischen Entwicklungen zusätzliche Bedingungen für die in den Artikeln 12 und 13 vorgesehene Haftungsfreistellung erforderlich sind und ob die Grundsätze des Binnenmarkts auf nicht angeforderte kommerziellen Kommunikationen mittels elektronischer Post angewendet werden können.
