Antrag auf Erteilung auf der Grundlage eines Antrags, der höherrangig ist als der Hilfsantrag, der der Mitteilung nach Regel 71 (3) zugrunde lag.

Der Grund dafür ist, dass ein Hilfsantrag nur für den Fall eingereicht wird, dass der höherrangige Antrag von der Kammer zurückgewiesen wird.

Somit ist das zusätzliche Merkmal in Anspruch 1 von Hilfsantrag 1 nicht geeignet, den Einwand der mangelnden erfinderischen Tätigkeit zu beheben, zumindest im Hinblick auf die Variante a), die den Einsatz von Molkenproteinen bzw. Molkenproteinhydrolysaten aus Sauermolke betrifft.
