Prioritätserklärung

Der Anmelder muss die Angaben und Nachweise gemäß Absatz 1 dem Amt innerhalb einer Frist von drei Monaten nach Empfang der Prioritätserklärung vorlegen.

The applicant shall submit to the Office the indications and evidence referred to in paragraph 1 within three months of receipt of the declaration of priority.

4.1 Bei der Abwägung der Interessen Dritter gegen die der Anmelderin ist die Kammer unter den besonderen Umständen des vorliegenden Falls, in dem es um einen bloßen Schreibfehler geht, zu der Überzeugung gelangt, daß die Interessen Dritter durch eine antragsgemäße Berichtigung der Prioritätserklärung nicht verletzt werden.

4.1. In weighing up the interests of third parties and those of the applicant, the Board is satisfied in the particular circumstances of this case, involving as it does a mere typing error, that the interests of third parties will not be adversely affected by a correction of the priority declaration as requested.

5.2.1 Bei der Abwägung der Interessen Dritter gegen die des Anmelders ist die Kammer unter den besonderen Umständen des vorliegenden Falls, in dem es um bloße Versehen einer Bürokraft geht, zu der Überzeugung gelangt, daß die Interessen Dritter durch eine antragsgemäße Berichtigung der Prioritätserklärung nicht verletzt werden.

5.2.1 In weighing up the interests of third parties and those of the applicant, the Board is satisfied in the particular circumstances of this case, involving as it does purely clerical errors, that the interests of third parties will not be adversely affected by a correction of the priority declaration as requested.

Bei der Abwägung der Interessen Dritter gegen die des Anmelders ist die Kammer unter den besonderen Umständen des vorliegenden Falles zu der Überzeugung gelangt, daß die Interessen Dritter durch eine antragsgemäße Berichtigung der Prioritätserklärung nicht verletzt werden.

4. Bisher betrafen die meisten Berichtigungsanträge nach Regel 88 EPÜ, über die die Kammer zu entscheiden hatte, die Benennung von Staaten und die Prioritätserklärung.

4. To date the majority of requests for corrections under Rule 88 which have been adjudicated upon by the Board have concerned designations of States and priority declarations.

Will der Anmelder eine Ausstellungspriorität nach Einreichung der Anmeldung in Anspruch nehmen, so ist die Prioritätserklärung unter Angabe der Ausstellung und des Datums der ersten Zurschaustellung der Waren und Dienstleistungen innerhalb einer Frist von zwei Monaten nach dem Anmeldetag vorzulegen.

Where the applicant wishes to claim an exhibition priority subsequently to the filing of the application, the declaration of priority, indicating the name of the exhibition and the date of the first display of the goods or services, shall be submitted within a period of two months from the filing date.
