Das IPRG ersetzt das Bundesgesetz betreffend die zivilrechtlichen Verhältnisse der Niedergelassenen und Aufenthalter vom 1. Januar, welches personen-, familien- und erbrechtliche Probleme regelte. Das Schuldrecht war darin nicht enthalten. Im Deliktsrecht galt in Nachvollziehung der Rechtsprechung des deutschen Reichsgerichts die Ubiquitätstheorie, das heisst, Rechtswahlmöglichkeit des Geschädigten zwischen dem Recht des Handlungsortes und dem Recht des Erfolgsortes.
