Bei Konzentrationen größer als 6% stellt sich die Frage nicht, dann ist es ein Medizinprodukt. Der Verwaltungsgerichtshof Baden-Württemberg hat dahingehend ein Urteil (02.01.2008-9 S2089/06) gefällt, sogar unabhängig der möglichen Konzentrationen. Die Scientific Committee on Consumer Products Opinion SCCP/1129/07 von 2007 behandelt ebenfalls das Thema Wasserstoffperoxidkonzentrationen , jedoch in Kosmetika .
