( 2 ) Im Anhang der Verordnung ( EWG ) Nr. 2358 / 71 ist einhaeusiger Cannabis sativa L. unter den Erzeugnissen aufgefuehrt , fuer die eine Erzeugungsbeihilfe fuer Basissaatgut oder zertifiziertes Saatgut gewaehrt werden kann . Einige Sorten von zweihaeusigem Cannabis sativa L. sind hinsichtlich ihres Tetrahydrocannabinol-Gehalts ( THC ) mit einhaeusigen Sorten vergleichbar . In Artikel 3 Absatz 1 der Verordnung ( EWG ) Nr. 619 / 71 des Rates vom 22. Maerz 1971 zur Festlegung der Grundregeln fuer die Gewaehrung einer Beihilfe fuer Flachs und Hanf ( 5 ) hat der Rat festgelegt , dass die Erzeugungsbeihilfe nur fuer Hanf gewaehrt wird , der nach der Kornbildung geerntet wird und aus zertifiziertem Saatgut von Sorten stammt , die in einer Liste aufgefuehrt sind , die nach dem Verfahren des Artikels 12 der Verordnung ( EWG ) Nr. 1308 / 70 des Rates vom 29. Juni 1970 ueber die gemeinsame Marktorganisation fuer Flachs und Hanf ( 6 ) aufzustellen ist . Im Hinblick auf die Gewaehrung der Beihilfe fuer die Hanferzeugung in den Wirtschaftsjahren 1998 / 99 bis 2000 / 2001 hat der Rat bestimmt , dass nur Hanfsorten , deren festgestellter THC-Gehalt 0,3 % und fuer die folgenden Wirtschaftsjahre 0,2 % nicht uebersteigt , in dieser Liste aufgefuehrt werden duerfen . Daher sollte der Anhang der Verordnung ( EWG ) Nr. 2358 / 71 dahin gehend geaendert werden , dass fuer Sorten von Cannabis sativa L. im Wirtschaftsjahr 2000 / 2001 ein THC-Gehalt von 0,3 % und fuer die folgenden Wirtschaftsjahre ein THC-Gehalt von 0,2 % gilt , und diese Sorten nach dem Verfahren des Artikels 11 der Verordnung ( EWG ) Nr. 2358 / 71 bestimmt werden .

( 2 ) The Annex to Regulation ( EEC ) No 2358 / 71 lists Cannabis sativa L. ( monoecious ) among the products on which production aid is payable for basic and certified seed ; certain varieties of dioecious Cannabis sativa L. are now comparable with the monoecious varieties as regards their tetrahydrocannabinol ( THC ) content ; in Article 3 ( 1 ) of Council Regulation ( EEC ) No 619 / 71 of 22 March 1971 laying down general rules for granting aid for flax and hemp ( 5 ) , the Council stipulates that production aid is to be granted solely on hemp harvested after seed formation and grown from certified seed of varieties on a list to be drawn up in accordance with the procedure laid down in Article 12 of Council Regulation ( EEC ) No 1308 / 70 of 29 June 1970 on the common organisation of the market in flax and hemp ( 6 ) ; for the purposes of granting aid for the production of hemp for the 1998 / 1999 , 1999 / 2000 and 2000 / 2001 marketing years , the Council has specified that only varieties found to have a THC content of not less than 0,3 % and , for subsequent marketing years , of not less than 0,2 % are to appear on that list ; the Annex to Regulation ( EEC ) No 2358 / 71 should accordingly be amended to refer to Cannabis sativa L. of varieties with a THC content not exceeding 0,3 % for the 2000 / 2001 marketing year and 0,2 % thereafter and those varieties should be determined in accordance with the procedure laid down in Article 11 of Regulation ( EEC ) No 2358 / 71 ;

Durch diese Massnahme koennten die beim Wechsel der Wirtschaftsjahre durch Liefervertraege gebundenen Geschaeftsleute benachteiligt werden , traegt man der Zeit Rechnung , die fuer eine Befoerderung von Europa bis zu den franzoesischen ueberseeischen Departements , den Azoren , Madeira und den Kanarischen Inseln erforderlich ist . Von den betreffenden Bestimmungen sollte deshalb zur Erleichterung des Uebergangs vom Wirtschaftsjahr 1993 / 94 auf das Wirtschaftsjahr 1994 / 95 abgewichen werden .

Whereas there is a significant reduction in common prices with effect from the 1993 / 94 marketing year ; whereas as a result of the time needed for consignments to reach the French overseas departments , the Azores , Madeira and the Canary Islands from the continental part of the Community , this adjustment is likely to penalize operators having supply commitments at the end of the marketing year ; whereas it is therefore vital to derogate from these provisions in order to facilitate the transition from the 1993 / 94 to the 1994 / 95 marketing year ;

( 1 ) Die Mitgliedstaaten richten die in Artikel 2 Absatz 4 genannte Datenbank vor dem Wirtschaftsjahr 2002 / 03 ein . Die die Datenbank betreffende Eintragungspflicht wird fuer die Wirtschaftsjahre 1999 / 2000 , 2000 / 01 und 2001 / 02 vor dem 1. September 1999 ersetzt durch die Auflage , die Datenbankeintragungen gemaess Artikel 4 Absatz 2 zu beantragen . Die Bezugs- und Kenndaten der Anbauflaechen sind die Grundbucheintragungen oder andere Angaben , die von der mit der Anbauflaechenkontrolle beauftragten Kontrollstelle als gleichwertig anerkannt sind .

1 . The Member States must have set up the database referred to in Article 2 ( 4 ) before the start of the 2002 / 03 marketing year . During the 1999 / 2000 , 2000 / 01 and 2001 / 02 marketing years , the obligation to register in the database shall be replaced by an obligation to submit an application for registration in the database in accordance with Article 4 ( 2 ) before 1 September 1999 ; the references relating to the area and identification of plots shall be the land-registry references or other indications recognised as equivalent by the body responsible for checks on the areas .

Die Wirtschaftsjahre sind daher so, wie sie in diesen Sektoren festgesetzt worden sind, in die vorliegende Verordnung aufzunehmen.

The marketing years as they have been fixed in these sectors should, therefore, be incorporated into this Regulation.
