KAPITEL 64 SCHUHE , GAMASCHEN UND AeHNLICHE WAREN ; TEILE DAVON Anmerkungen 1. Zu Kapitel 64 gehoeren nicht : a ) Fussbekleidung aus Spinnstoffen , ohne angebrachte Sohlen ( Kapitel 61 oder 62 ) ; b ) gebrauchte Schuhe der Position 6309 ; c ) Waren aus Asbest ( Position 6812 ) ; d ) orthopaedische Schuhe , orthopaedische Apparate und andere orthopaedische Vorrichtungen , Teile davon ( Position 9021 ) ; e ) Schuhe , die den Charakter von Spielzeug haben , und Schuhe mit fest angebrachten Schlittschuhen oder Rollschuhen ; Schienbeinschuetzer und aehnliche Sportschutzausruestungen ( Kapitel 95 ) . 2. Als _DOUBLEQUOTE_ Teile _DOUBLEQUOTE_ im Sinne der Position 6406 gelten nicht Stifte , Sohlenschuetzer , Oesen , Haken , Schnallen , Tressen , Pompons , Schnuersenkel und andere Zier- und Posamentierwaren ( Einreihung nach ihrer sonstigen stofflichen Beschaffenheit ) , Schuhknoepfe und andere Waren der Position 9606 . 3. Als _DOUBLEQUOTE_ Kautschuk oder Kunststoff _DOUBLEQUOTE_ im Sinne des Kapitels 64 gelten auch Gewebe oder andere Spinnstofferzeugnisse , mit einer sichtbaren Aussenschicht aus Kautschuk oder Kunststoff . 4. Vorbehaltlich der Anmerkung 3 zu Kapitel 64 gelten als : a ) Stoff des Oberteils der Stoff , der den groessten Teil der Aussenflaeche bildet , unabhaengig von Zubehoer- oder Verstaerkungsteilen wie Randeinfassungen , Knoechelschuetzer , Verzierungen , Schnallen , Laschen , Oesen oder aehnliche Vorrichtungen ; b ) Stoff der Laufsohle der Stoff , der den groessten Teil der Beruehrungsflaeche mit dem Boden bildet , unabhaengig von Zubehoer- oder Verstaerkungsteilen wie Dornen , Stollen , Naegel , Sohlenschuetzer oder aehnliche Vorrichtungen . Unterpositions-Anmerkung 1. Als _DOUBLEQUOTE_ Sportschuhe _DOUBLEQUOTE_ im Sinne der Unterpositionen 6402 11 , 6402 19 , 6403 11 , 6403 19 und 6404 11 gelten nur : a ) Schuhe , die fuer die Ausuebung einer Sportart bestimmt und mit Dornen , Krampen , Klammern , Stollen oder aehnlichen Vorrichtungen versehen oder fuer deren Anbringung hergerichtet sind ; b ) Schuhe fuer Schlittschuhe oder Rollschuhe ; Skistiefel , Skilanglaufschuhe , Ringerschuhe , Boxerstiefel oder Radsportschuhe . Zusaetzliche Anmerkung 1. Im Sinne der Anmerkung 4 Buchstabe a ) gelten als _DOUBLEQUOTE_ Verstaerkungsteile _DOUBLEQUOTE_ alle Teile ( z. B. aus Kunststoff oder Leder ) , die die Aussenflaeche des Oberteils bedecken , ihm eine hoehere Festigkeit verleihen und mit der Sohle verbunden sein koennen . Nach Entfernung der Verstaerkungsteile muss der sichtbare Teil die charakteristischen Merkmale eines Oberteils und nicht die eines Futters aufweisen . Bei der Bestimmung des Stoffes , aus dem das Oberteil besteht , sind die Flaechen des Oberteils zu beruecksichtigen , die von Zubehoer- oder Verstaerkungsteilen bedeckt sind .

CHAPTER 64 FOOTWEAR , GAITERS AND THE LIKE ; PARTS OF SUCH ARTICLES Notes 1 . This chapter does not cover : ( a ) footwear without applied soles , of textile material ( Chapter 61 or 62 ) ; ( b ) worn footwear of heading No 6309 ; ( c ) articles of asbestos ( heading No 6812 ) ; ( d ) orthopaedic footwear or other orthopaedic appliances , or parts thereof ( heading No 9021 ) ; or ( e ) toy footwear or skating boots with ice or roller skates attached ; shin-guards or similar protective sportswear ( Chapter 95 ) . 2 . For the purposes of heading No 6406 , the expression 'parts ' does not include pegs , boot protectors , eyelets , boot hooks , buckles , ornaments , braid , laces , pompons or other trimmings ( which are to be classified in their appropriate headings ) or buttons or other goods of heading No 9606 . 3 . For the purposes of this chapter , the expressions 'rubber ' or 'plastics ' include any textile material visibly coated or covered externally with one or both of those materials . 4 . Subject to note 3 to this chapter : ( a ) the material of the upper shall be taken to be the constituent material having the greatest external surface area , no account being taken of accessories or reinforcements such as ankle patches , edging , ornamentation , buckles , tabs , eyelet stays or similar attachments ; ( b ) the constituent material of the outer sole shall be taken to be the material having the greatest surface area in contact with the ground , no account being taken of accessories or reinforcements such as spikes , bars , nails , protectors or similar attachments . Subheading note 1 . For the purposes of subheadings 6402 11 , 6402 19 , 6403 11 , 6403 19 and 6404 11 , the expression 'sports footwear ' applies only to : ( a ) footwear which is designed for a sporting activity and has , or has provision for the attachment of , spikes , sprigs , stops , clips , bars or the like ; ( b ) skating boots , ski-boots and cross-country ski footwear , wrestling boots , boxing boots and cycling shoes . Additional note 1 . Within the meaning of note 4 ( a ) , ' reinforcements ' is taken to mean all pieces of material ( e.g. , plastics or leather ) attached to the external surface of the upper to give additional strength , whether or not also attached to the sole . After the removal of reinforcements , the visible material must have the characteristics of an upper and not lining . Account is to be taken of sections covered by accessories or reinforcements when deciding on the composition of the upper .
