17.2. Das in Ziffer 1 dieses Artikels genannte Schiedsgericht wird von Fall zu Fall gebildet. Es besteht aus drei Mitgliedern. Jede Vertragspartei ernennt ein Mitglied, und diese beiden Mitglieder bestimmen ein drittes Mitglied, das den Vorsitz des Schiedsgerichtes wahrnimmt. Hat eine der Vertragsparteien binnen zwei Monaten nach dem Zeitpunkt, zu dem die Anrufung eines Schiedsgerichtes in einer Streitigkeit beantragt worden ist, kein Mitglied bestellt oder haben sich die beiden Mitglieder des Gerichts innerhalb eines Monats nach der Wahl des zweiten Mitglieds des Schiedsgerichtes nicht über die Ernennung des dritten Mitglieds geeinigt, so wird der Präsident des Internationalen Gerichtshofs von der Vertragspartei bzw. den Vertragsparteien aufgefordert, das betreffende Mitglied zu bestellen.

17.2. The board of arbitrators referred to in paragraph 1 of this Article shall be established for each individual case. It shall be composed of three members. Each Contracting Party shall appoint one member and these two members shall agree upon the appointment of the third member, who shall be the chairman of the board.
