Es sei darauf hingewiesen, dass zum Zeitpunkt des Kontrollbesuchs keinerlei Aktivitäten (weder Produktion noch Montage) festzustellen waren, kein Personal vor Ort war und es auch keine Lagerbestände gab. Das Unternehmen legte dar, dass es im UZ Montagevorgänge durchführte, wie die Maschinen und die vorgelegte Personalliste zeigten, seine Tätigkeit aber kurz vor Einleitung dieser Untersuchung stoppte und noch nicht entschieden hätte, ob es die Tätigkeit wieder aufnehmen werde. Auf dieser Grundlage konnte keine Produktionskapazität ermittelt werden.

51. It should be noted that at the time of the verification visit, it was found that no activity (neither production nor assembly) was taking place, no personnel was present and no stocks existed. The company explained that although they had assembly operations during the IP, as shown in particular by the machinery, and a personnel list which was provided, they had stopped the operations shortly before the initiation of the present investigation and had not decided yet whether or not they would restart the activity. On this basis, the existence of a production capacity could not be established.
