So war unter u.a. im Erkenntnis vom 15.09.2011 eine der Kernfragen, ob sich die Richtlinie hinsichtlich des Planungsverfahrens nur an den Planungsträger richtet, oder auch an die Baugenehmigungsbehörde. Eine weitere wesentliche Entscheidungsfrage dabei war auch die in Österreich für Diskussion sorgende „heranrückende Bebauung“, dh. dass Wohngebiete zu einem entsprechenden, von der Richtlinie umfassten Betrieb, nach Eröffnung des Betriebes zunehmend „heran rückend“ gebaut und ausgebaut werden.
