Dear Sir, Reference is made to your e-mail to Kaupthing hf. with the heading “Complaint and lodging a new claim”. Regarding the “complaint” At the general creditors meeting of Kaupthing hf. on 31 May 2012 the Winding-up Committee discussed its intension to pay priority claims and gave an overview of possible method and currency of such payments. However the Winding-up Committee did not submit to the meeting any formal and complete proposal of such payments. It should be noted that the Act on Financial Undertaking No 161/2002 (“the AFU”) and the Act on Bankruptcy etc. No 21/1991 (“The Bankruptcy Act”) do not require for the Winding-up Committee to seek formal approval from creditors

Sehr geehrter Herr, wird auf Ihre E-mail an Kaupthing HF mit dem Titel "Beschwerde" Übernachtung einen neuen Anspruch verwiesen. Bezüglich der "Beschwerde" Auf der Sitzung allgemeine Gläubiger der Kaupthing HF. 31. Mai 2012 der Liquidation-Ausschuss diskutiert seine Intension um vorrangige Forderungen zu bezahlen und gab einen Überblick über mögliche Methode und Währung solcher Zahlungen. Jedoch der Liquidation-Ausschuss nicht zur Sitzung übermittelt haben formale und vollständige Vorschlag solcher Zahlungen. Es sei darauf hingewiesen, die das Gesetz über finanzielle Unternehmen Nr. 161/2002 ("die AFU") und das Gesetz über Konkurs etc.. Nr. 21/1991 ("The Bankruptcy Act") benötigen keine für die Liquidation-Ausschuss, Entlastung von Gläubigern zu suchen

(14) Pursuant to the Bankruptcy Act, the company applying for an arrangement with creditors has to submit to the supervising court a list of measures for its reorganisation and for the ongoing financing of its activity after the arrangement.

(14) Nach dem Insolvenzgesetz muss eine Firma, die einen Vergleich mit den Gläubigern beantragt, dem Gericht eine Aufstellung der Maßnahmen zur Reorganisation der Gesellschaft sowie zur vorläufigen Finanzierungstätigkeit der Gesellschaft nach diesem Vergleich vorlegen.

This procedure is governed by Act 328/91 on Bankruptcy and Arrangement with Creditors ("Bankruptcy Act").

As a result, the beneficiary became an indebted company within the meaning of the Bankruptcy Act.

Infolge dessen geriet die Firma nach dem Insolvenzgesetz in Konkurs.
