This approach is also in line with the Commission's guidelines for the calculation of the amount of subsidy in countervailing duty investigations as set forth in particular in Table 2 which is attached to the said guidelines.

( 15 ) Article VI3 GATT 1994 , which is reproduced in Article 19 ( 4 ) of the ASCM , only states that duties must not be levied in excess of the amount of the subsidy . The amount of the subsidy is calculated in terms of benefit found to exist in the investigation period ( Article 14 ASCM ) . Since the company also benefited from the fact that it did not have to source the funds on the financial market , the amount of benefit must also include an interest element . Consequently , since the amount of benefit ( including interest ) corresponds to the amount of the subsidy and the countervailing duty is calculated in terms of the subsidy margin found , Article VI ( 3 ) GATT 1994 is filly respected by the addition of interest .

Da die Hoehe des Vorteils ( einschliesslich Zinsen ) der Hoehe der Subvention entspricht und der Ausgleichszoll auf der Hoehe der Subventionsspannen festgesetzt wurde , steht die Verzinsung mit Artikel VI Absatz 3 des GATT 1994 voll und ganz in Einklang .
