CHAPTER 71 NATURAL OR CULTURED PEARLS , PRECIOUS OR SEMI-PRECIOUS STONES , PRECIOUS METALS , METALS CLAD WITH PRECIOUS METAL , AND ARTICLES THEREOF ; IMITATION JEWELLERY ; COIN Notes 1 . Subject to note 1 ( a ) to Section VI and except as provided below , all articles consisting wholly or partly : ( a ) of natural or cultured pearls or of precious or semi-precious stones ( natural , synthetic or reconstructed ) ; or ( b ) of precious metal or of metal clad with precious metal , are to be classified in this chapter . 2 . ( a ) Heading Nos 7113 , 7114 and 7115 do not cover articles in which precious metal or metal clad with precious metal is present as minor constituents only , such as minor fittings or minor ornamentation ( for example , monograms , ferrules and rims ) , and paragraph ( b ) of the foregoing note does not apply to such articles . ( b ) Heading No 7116 does not cover articles containing precious metal or metal clad with precious metal ( other than as minor constituents ) . 3 . This chapter does not cover : ( a ) amalgams of precious metal , or colloidal precious metal ( heading No 2843 ) ; ( b ) sterile surgical suture materials , dental fillings or other goods of Chapter 30 ; ( c ) goods of Chapter 32 ( for example , lustres ) ; ( d ) handbags or other articles of heading No 4202 or articles of heading No 4203 ; ( e ) articles of heading No 4303 or 4304 ; ( f ) goods of Section XI ( textiles and textile articles ) ; ( g ) footwear , headgear or other articles of Chapter 64 or 65 ; ( h ) umbrellas , walking-sticks or other articles of Chapter 66 ; ( ij ) abrasive goods of heading No 6804 or 6805 or Chapter 82 , containing dust or powder of precious or semi-precious stones ( natural or synthetic ) ; articles of Chapter 82 with a working part of precious or semi-precious stones ( natural , synthetic or reconstructed ) ; machinery , mechanical appliances or electrical goods , or parts thereof , of Section XVI . However , articles and parts thereof , wholly of precious or semi-precious stones ( natural , synthetic or reconstructed ) remain classified in this chapter , except unmounted worked sapphires and diamonds for styluses ( heading No 8522 ) ; ( k ) articles of Chapter 90 , 91 or 92 ( scientific instruments , clocks and watches , musical instruments ) ; ( l ) arms or parts thereof ( Chapter 93 ) ; ( m ) articles covered by note 2 to Chapter 95 ; ( n ) articles classified in Chapter 96 by virtue of note 4 to that chapter ; or ( o ) original sculptures or statuary ( heading No 9703 ) , collectors ' pieces ( heading No 9705 ) or antiques of an age exceeding 100 years ( heading No 9706 ) , other than natural or cultured pearls or precious or semi-precious stones . 4 . ( a ) The expression 'precious metal ' means silver , gold and platinum . ( b ) The expression 'platinum ' means platinum , iridium , osmium , palladium , rhodium and ruthenium . ( c ) The expression 'precious or semi-precious stones ' does not include any of the substances specified in note 2 ( b ) to Chapter 96 . 5 . For the purposes of this chapter , any alloy ( including a sintered mixture and an inter-metallic compound ) containing precious metal is to be treated as an alloy of precious metal if any one precious metal constitutes as much as 2 % , by weight , of the alloy . Alloys of precious metal are to be classified according to the following rules : ( a ) An alloy containing 2 % or more , by weight , of platinum is to be treated as an alloy of platinum . ( b ) An alloy containing 2 % or more , by weight , of gold but no platinum , or less than 2 % , by weight , of platinum , is to be treated as an alloy of gold . ( c ) Other alloys containing 2 % or more , by weight , of silver are to be treated as alloys of silver . 6 . Except where the context otherwise requires , any reference in the nomenclature to precious metal or to any particular precious metal includes a reference to alloys treated as alloys of precious metal or of the particular metal in accordance with the rules in note 5 above , but not to metal clad with precious metal or to base metal or non-metals plated with precious metal . 7 . Throughout the nomenclature the expression 'metal clad with precious metal ' means material made with a base of metal upon one or more surfaces of which there is affixed by soldering , brazing , welding , hot-rolling or similar mechanical means a covering of precious metal . Except where the context otherwise requires , the expression also covers base metal inlaid with precious metal . 8 . For the purposes of heading No 7113 , the expression 'articles of jewellery ' means : ( a ) any small objects of personal adornment ( gem-set or not ) ( for example , rings , bracelets , necklaces , brooches , ear-rings , watch-chains , fobs , pendants , tie-pins , cuff-links , dress-studs , religious or other medals and insignia ) ; and ( b ) articles of personal use of a kind normally carried in the pocket , in the handbag or on the person ( such as cigarette cases , powder boxes , chain purses , cachou boxes ) . 9 . For the purposes of heading No 7114 , the expression 'articles of goldsmiths ' or silversmiths ' wares ' includes such articles as ornaments , tableware , toilet-ware , smokers ' requisites and other articles of household , office or religious use . 10 . For the purposes of heading No 7117 , the expression 'imitation jewellery ' means articles of jewellery within the meaning of paragraph ( a ) of note 8 above ( but not including buttons or other articles of heading No 9606 , or dress-combs , hair-slides or the like , or hairpins , of heading No 9615 ) , not incorporating natural or cultured pearls , precious or semi-precious stones ( natural , synthetic or reconstructed ) nor ( except as plating or as minor constituents ) precious metal or metal clad with precious metal . Subheading notes 1 . For the purposes of subheadings 7106 10 , 7108 11 , 7110 11 , 7110 21 , 7110 31 and 7110 41 , the expressions 'powder ' and 'in powder form ' mean products of which 90 % or more by weight passes through a sieve having a mesh aperture of 0,5 mm . 2 . Notwithstanding the provisions of chapter note 4 ( b ) , for the purposes of subheadings 7110 11 and 7110 19 , the expression 'platinum ' does not include iridium , osmium , palladium , rhodium or ruthenium . 3 . For the classification of alloys in the subheadings of heading No 7110 , each alloy is to be classified with that metal , platinum , palladium , rhodium , iridium , osmium or ruthenium which predominates by weight over each other of these metals . Additional note 1 . For the purposes of heading No 7112 , the expression 'waste and scrap , of precious metal ' means products fit only for the recovery of the metal or for use in the manufacture of chemicals .

Zu Kapitel 71 gehoeren , vorbehaltlich der Anmerkung 1 Buchstabe a ) zu Abschnitt VI und der nachstehenden Ausnahmen , alle Waren , die ganz oder teilweise bestehen : a ) aus echten Perlen oder Zuchtperlen oder aus Edelsteinen , Schmucksteinen oder synthetischen oder rekonstituierten Steinen , oder b ) aus Edelmetallen oder Edelmetallplattierungen . 2. a ) Zu den Positionen 7113 , 7114 und 7115 gehoeren nicht Waren , die Edelmetalle oder Edelmetallplattierungen nur als einfache Verzierungen oder als unwesentliche Zutaten ( z.B. Monogramme , Ringbeschlaege , Kanten ) enthalten ; auf diese Waren findet die vorstehende Anmerkung 1 Buchstabe b ) keine Anwendung. b ) Zu Position 7116 gehoeren nur Waren , die Edelmetalle oder Edelmetallplattierungen nicht oder nur als einfache Verzierungen oder unwesentliche Zutaten enthalten . 3. Zu Kapitel 71 gehoeren nicht : a ) Edelmetallamalgame oder Edelmetalle in kolloidem Zustand ( Position 2843 ) ; b ) steriles chirurgisches Nahtmaterial , Zahnfuellstoffe und andere Waren des Kapitels 30 ; c ) Waren des Kapitels 32 ( z.B. fluessige Glanzmittel ) ; d ) Handtaschen und andere Waren der Position 4202 und Waren der Position 4203 ; e ) Waren der Position 4303 oder 4304 ; f ) Waren des Abschnitts XI ( Spinnstoffe und Waren daraus ) ; g ) Schuhe , Kopfbedeckungen und andere Waren des Kapitels 64 oder 65 ; h ) Schirme , Gehstoecke und andere Waren des Kapitels 66 ; ij ) Waren aus Schleifstoffen , die Pulver von Edelsteinen , Schmucksteinen oder synthetischen Steinen enthalten , der Position 6804 oder 6805 oder des Kapitels 82 , Werkzeuge oder andere Waren des Kapitels 82 , mit arbeitendem Teil aus Edelsteinen , Schmucksteinen , synthetischen oder rekonstituierten Steinen ; Maschinen , Apparate , elektrotechnische Erzeugnisse und Teile davon , des Abschnitts XVI ; Waren und Teile davon , ganz aus Edelsteinen , Schmucksteinen oder synthetischen oder rekonstituierten Steinen , bleiben jedoch im Kapitel 71 , ausgenommen bearbeitete , nicht montierte Saphire und Diamanten fuer Tonabnehmer-Abtastnadeln ( Position 8522 ) ; k ) Waren des Kapitels 90 , 91 oder 92 ( wissenschaftliche Instrumente , Uhrmacherwaren und Musikinstrumente ) ; l ) Waffen und Teile davon ( Kapitel 93 ) ; m ) Waren , die von Anmerkung 2 zu Kapitel 95 erfasst sind ; n ) Waren des Kapitels 96 gemaess Anmerkung 4 zu jenem Kapitel ; o ) Originalerzeugnisse der Bildhauerkunst ( Position 9703 ) , Sammlungsstuecke ( Position 9705 ) und Antiquitaeten , mehr als 100 Jahre alt ( Position 9706 ) . Echte Perlen oder Zuchtperlen , Edelsteine oder Schmucksteine bleiben jedoch in Kapitel 71. 4. a ) Als _DOUBLEQUOTE_ Edelmetalle _DOUBLEQUOTE_ gelten Silber , Gold und Platin. b ) Als _DOUBLEQUOTE_ Platin _DOUBLEQUOTE_ gelten Platin , Iridium , Osmium , Palladium , Rhodium und Ruthenium. c ) Als _DOUBLEQUOTE_ Edelsteine , Schmucksteine und synthetische oder rekonstituierte Steine _DOUBLEQUOTE_ gelten nicht die in Anmerkung 2 Buchstabe b ) zu Kapitel 96 genannten Stoffe . 5. Als _DOUBLEQUOTE_ Edelmetallegierungen _DOUBLEQUOTE_ im Sinne des Kapitels 71 gelten alle Legierungen ( einschliesslich gesinterte Mischungen und intermetallische Verbindungen ) , die ein oder mehrere Edelmetalle enthalten , vorausgesetzt , dass das Gewicht eines Edelmetalls 2 GHT oder mehr der Legierung betraegt . Edelmetallegierungen sind wie folgt einzureihen : a ) alle Legierungen , die 2 GHT oder mehr Platin enthalten , als Platinlegierungen ; b ) alle Legierungen , die 2 GHT oder mehr Gold , jedoch kein Platin oder weniger als 2 GHT Platin enthalten , als Goldlegierungen ; c ) andere Legierungen , die 2 GHT oder mehr Silber enthalten , als Silberlegierungen . 6. Der Begriff _DOUBLEQUOTE_ Edelmetalle _DOUBLEQUOTE_ oder die Nennung eines bestimmten Edelmetalls umfasst in der Nomenklatur , wenn nichts anderes bestimmt ist , auch die Legierungen , die nach Anmerkung 5 als Edelmetallegierungen einzureihen sind , jedoch weder Edelmetallplattierungen nach Anmerkung 7 noch unedle Metalle oder Nichtmetalle , die platiniert , vergoldet oder versilbert sind . 7. Als _DOUBLEQUOTE_ Edelmetallplattierungen _DOUBLEQUOTE_ im Sinne der Nomenklatur gelten Waren , bei denen auf einer Metallunterlage auf einer Seite oder mehreren Seiten Edelmetalle durch Loeten , Schweissen , Warmwalzen oder aehnliche mechanische Verfahren aufgebracht sind . Waren aus unedlen Metallen mit eingelegten Edelmetallen sind , wenn nichts anderes bestimmt ist , als Edelmetallplattierungen einzureihen . 8. Als _DOUBLEQUOTE_ Schmuckwaren _DOUBLEQUOTE_ im Sinne der Position 7113 gelten : a ) kleine Gegenstaende , die als Schmuck dienen ( z.B. Fingerringe , Armbaender , Halsketten , Broschen , Ohrringe , Uhrketten , Uhrgehaenge , Anhaenger , Krawattennadeln , Manschettenknoepfe , religioese oder andere Medaillen oder Abzeichen ) ; b ) Gegenstaende des persoenlichen Gebrauchs , die dazu bestimmt sind , an der Person getragen zu werden , sowie Taschen- und Handtaschenartikel ( z.B. Zigaretten- oder Zigarrenetuis , Schnupftabakdosen , Bonbonnieren und Puderdosen , Panzertaeschchen , Rosenkraenze ) . Als _DOUBLEQUOTE_ Schmuckwaren _DOUBLEQUOTE_ im Sinne der Position 7113 gelten auch solche Waren aus Edelmetallen oder Edelmetallplattierungen , die echte Perlen , Zuchtperlen oder Imitationsperlen , Edelsteine oder Schmucksteine , Edelstein- oder Schmucksteinimitationen sowie synthetische oder rekonstituierte Steine enthalten oder auch Teile aus Schildpatt , Perlmutter , Elfenbein , natuerlichem oder rekonstituiertem Bernstein , Gagat ( Jett ) oder Korallen haben . 9. Als _DOUBLEQUOTE_ Gold- und Silberschmiedewaren _DOUBLEQUOTE_ im Sinne der Position 7114 gelten Waren wie Tafelgeraete , Toilettengarnituren , Schreibtischgarnituren , Rauchservice , Gegenstaende zur Innenausstattung und Geraete fuer religioese Zwecke . 10. Als _DOUBLEQUOTE_ Phantasieschmuck _DOUBLEQUOTE_ im Sinne der Position 7117 gelten Waren von der in der Anmerkung 8 Buchstabe a ) genannten Art ( ausgenommen Knoepfe und andere Waren der Position 9606 , Einsteckkaemme , Haarspangen und aehnliche Waren sowie Haarnadeln der Position 9615 ) , wenn sie weder echte Perlen oder Zuchtperlen , Edelsteine , Schmucksteine , synthetische oder rekonstituierte Steine noch - abgesehen von einfachen Verzierungen oder unwesentlichen Zutaten - Edelmetalle oder Edelmetallplattierungen enthalten . Unterpositions-Anmerkungen 1. Die Begriffe _DOUBLEQUOTE_ Pulver _DOUBLEQUOTE_ und _DOUBLEQUOTE_ als Pulverform _DOUBLEQUOTE_ im Sinne der Unterpositionen 7106 10 , 7108 11 , 7110 11 , 7110 21 , 7110 31 und 7110 41 umfassen Erzeugnisse , die mit einem Anteil von 90 GHT oder mehr durch ein Sieb mit einer lichten Maschenweite von 0,5 mm hindurchgehen . 2.
