Since the parties agreed on an exclusion of warranty, Areal would only be liable for the defects in cases of fraudulent intent. Purpose of the hearing was to find evidence that Areal fraudulently concealed the defect. For this reason four witnesses were heard, two employees of the tenant (head of personnel Mr. Ohlert and security officer Mr. Wehrle), the technical expert Mr. Kwiatek and the architect of Areal Mr. Weber-Killmer.

Der Zweck dieser Anhörung war die Prüfung von vier Zeugen (Vertreter aus tenat VRR), ob defekte Decken (Abplatzungen und fallende Gips) in der Prämisse, VRR verpachtet waren noch ein Problem im Zeitpunkt der Veräußerung zu Vegagest und ob der Verkäufer Areal war oder hätte wissen diese Mängel haben. Da die Parteien einigten sich auf einen Ausschluss der Gewährleistung, würde Areal haftet nur für Mängel in Fällen betrügerische Absicht. Zweck der Anhörung war, nachzuweisen, dass Areal den Mangel arglistig verschwiegen zu finden. Aus diesem Grund vier Zeugen gehört wurden, zwei Mitarbeiter des Mieters (Personalchef Herrn Ohlert und Sicherheit Offizier Mr. Wehrle), die technischen Experten Mr. Kwiatek und der Architekt Areal Mr. Weber-Killmer.
