The inspecting authority shall undertake a compulsory check to ensure that the products are present in the warehouse during the final week of the contractual storage period.

For this purpose they shall designate a national authority to be responsible for checking storage operations (hereinafter referred to as "the inspecting authority").

Where it is established and verified by the inspecting authority that the declaration as referred to in Article 4(5)(a) is a false declaration made either deliberately or through serious negligence, the contracting party in question shall be excluded from the benefits of the private storage aid scheme until the end of the calendar year following the year in which the falsification is ascertained.

Stellt die Kontrollbehörde nach Überprüfung fest, daß ein Vertragspartner bei der Erklärung gemäß Artikel 4 Absatz 5 Buchstabe a) vorsätzlich oder grob fahrlässig falsche Angaben gemacht hat, so wird der Vertragspartner für das der Feststellung folgende Kalenderjahr von der Gewährung der Beihilfen zur privaten Lagerhaltung ausgeschlossen.
