use of the works

the Employer may reject the works or such part, provided that: (a) the failure is of a nature and extent that prevents or has an impact on the operational use of the works by the Employer or an end-user; and (b) the Contractor has been afforded a reasonable opportunity to take the required rectification action but has failed to do so or the action has failed to rectify the failure.
