Die Darlehenssumme S betraegt 1 000 ECU , jedoch behaelt der Darlehensgeber 50 ECU fuer Kreditwuerdigkeitspruefungs- und Bearbeitungskosten ein , so dass sich der effektive Darlehensbetrag auf 950 ECU belaeuft . Die Rueckzahlung der 1 200 ECU erfolgt wie im ersten Beispiel 1,5 Jahre nach der Darlehensaufnahme .

The sum loaned is S = ECU 1 000 , but the creditor retains ECU 50 for administrative expenses , so that the loan is in fact ECU 950 ; the repayment of ECU 1 200 , as in the first example , is again made 1,5 years after the date of the loan .

(1) Der Darlehensgeber tritt hiermit mit sämtlichen Ansprüchen aus dem in §1 genannten Darlehen gem. §19 Abs.2 S.3 InsO im Rang hinter sämtliche Forderungen anderer Gläubiger in der Weise zurück, dass Tilgung und Verzinsung des Darlehens nur nachrangig nach allen anderen Gläubigern im Rang des §39 Abs.1 Nr.1 bis 5 InsO, also im Rang des §39 Abs.2 InsO und nur aus sonstigem freien Vermögen verlangt werden können.
