Die Einspruchsabteilung hat in ihrer vorläufigen Stellungnahme die Neuheit mit dem Hinweis anerkannt, dass das in El erwähnte Polyethylen von Polytetrafluorethylen verschieden ist.

Der Einspruch gegen das Streitpatent wurde von der "Lisa Dräxlmaier GmbH" eingelegt und in der angefochtenen Entscheidung der Einspruchsabteilung wurde diese Firma als der Name der Einsprechenden mitgeteilt.

Der beschwerdeführende Patentinhaber, der vor der Einspruchsabteilung unterlegen ist, hat somit das Recht, die zurückgewiesenen Anträge von der Beschwerdekammer erneut prüfen zu lassen.
