Einleitung: § 6 Abs. 2 Satz 3 GmbHG bestimmt: Wer wegen einer Straftat nach den §§ 283 bis 283 d StGB verurteilt worden ist, kann auf die Dauer von 5 Jahren seit der Rechtskraft des Urteils nicht Geschäftsführer oder Liquidator einer GmbH sein. Die Regelung soll dem Schutz der Gesellschaft sowie der Gläubiger vor Wiederholungstaten dienen.
