72/2009 geänderten Fassung ist die öffentliche Intervention zu festen Preisen für Hartweizen, Gerste, Mais und Sorghum in der Zeit vom 1.

(5) Article 13(1)(a) of Regulation (EC) No 1234/2007, as amended by Regulation (EC) No 72/2009, limits public intervention at fixed price for durum wheat, barley, maize and sorghum to 0 tonnes for the period from 1 November to 31 May and for paddy rice to 0 tonnes for the period from 1 April to 31 July.

Unter Berücksichtigung der agronomischen Ähnlichkeiten von Sorghum und Mais müssen in dem Bemühen um Kohärenz entsprechende Maßnahmen für Sorghum vorgesehen werden.

Given the agronomic similarities of sorghum and maize, and in the interests of consistency, the same measures should be laid down for sorghum.

Die mit Artikel 6 der Verordnungen ( EWG ) Nr. 388 / 92 , ( EWG ) Nr. 1727 / 92 und ( EWG ) Nr. 1728 / 92 vorgesehene Anpassung wird nicht vorgenommen , wenn ein beteiligter Geschaeftsmann den im Bestimmungsgebiet zustaendigen Behoerden ueberzeugend nachweist , dass er das Getreide , mit Ausnahme von Mais und Sorghum , oder die Getreideerzeugnisse , die er zur Abbuchung in der Beihilfebescheinigung vorfuehrt , vor dem 1. Juli 1994 , im Fall von Mais und Sorghum , vor dem 1. Oktober 1994 versandt hat .

The adjustment provided for in Article 6 of Regulations ( EEC ) No 388 / 92 , ( EEC ) No 1727 / 92 and ( EEC ) No 1728 / 92 shall not apply if the operator provides proof to the satisfaction of the competent authorities in the destination region that the cereals and cereal products other than maize and sorghum presented for entry on the aid certificate were dispatched prior to 1 July 1994 , or , in the case of maize or sorghum before 1 October 1994 .

Im Interesse der Transparenz werden die repraesentativen cif-Einfuhrpreise der in Artikel 10 Absatz 3 Buchstabe a ) genannten Getreidearten folglich auf der Grundlage der Rohstoffboersennotierung fuer die betreffende Getreideart unter Additon der fuer diese Getreideart gewaehrten Handelspraemie und der Seefrachten zwischen dem Golf von Mexiko oder den nordamerikanischen Grossen Seen und dem Hafen von Rotterdam ermittelt . Um jedoch die je nach Bestimmungshafen unterschiedlichen Frachtkosten zu beruecksichtigen , ist es gerechtfertigt , pauschale Anpassungen des Einfuhrzolls fuer die Gemeinschaftshaefen vorzusehen , die am Mittelmeer , an der Atlantikkueste der Iberischen Halbinsel , im Vereinigten Koenigreich und in Irland oder in den skandinavischen Laendern gelegen sind . Damit die Entwicklung der so ermittelten repraesentativen cif-Einfuhrpreise verfolgt werden kann , empfiehlt es sich , eine taegliche Beobachtung der in ihre Berechnung eingehenden Elemente einzurichten . Im Fall von Sorghum und von Roggen ermoeglicht der fuer Gerste berechnete repraesentative cif-Einfuhrpreis eine Schaetzung der Marktsituation fuer die beiden genannten Erzeugnisse , so dass der repraesentative cif-Einfuhrpreis fuer Gerste gleichfalls auf diese Getreidearten anzuwenden ist .

Whereas , accordingly , for the sake of transparency the representative cif import prices of the cereals indicated at ( a ) in Article 10 ( 3 ) are to be established from commodity exchange quotations for the cereal in question plus the commercial premium assigned to the cereal and sea freight costs between the Gulf of Mexico or the Great Lakes and the port of Rotterdam ; whereas however freight cost differences by port of destination justify flat rate adjustment of the import duty for Community ports located in the Mediterranean , on the Atlantic coast of the Iberian Peninsula and in the United Kingdom , Ireland and the Scandinavian countries ; whereas the factors of calculation of the representative cif import prices so established should be monitored daily so that the trend of these prices can be followed ; whereas , in the case of sorghum and rye , the representative cif import price calculated for barely allows the market situation for those two products to be estimated and consequently the representative cif import price determined for barley applies for these cereals ;
