(3) Ungeachtet des Absatzes 2 sind Verfahren vom Anwendungsbereich dieses Übereinkommens nicht ausgeschlossen, wenn eine nach Absatz 2 ausgeschlossene Angelegenheit lediglich als Vorfrage auftritt und nicht Gegenstand des Verfahrens ist.

Ist in einem Rechtsstreit vor einem Gericht eines Mitgliedstaats die Frage der Anerkennung einer Entscheidung als Vorfrage zu klären, so kann dieses Gericht hierüber befinden.

Where the recognition of a judgment is raised as an incidental question in a court of a Member State, that court may determine that issue.

Auch die Herbeiführung einer Entscheidung, die in Uebereinstimmung mit der gleichlautenden Lösung der andern am Rechtsverhältnis nahe beteiligten Staaten steht, kann die Anwendung der Ausnahmeklausel rechtfertigen.
