(74) Die Chemische Fabrik Budenheim A. Oetker (nachstehend CFB) bezweifelte in ihrem Schreiben vom 20. August 2001 die Tragfähigkeit des Umstrukturierungskonzeptes. Der Bau der neuen Extraktionsanlage sei zu so geringen Kosten und in so kurzer Zeit wie von CWP geplant nicht realisierbar. Dies habe sich nachträglich bestätigt, denn nach Marktinformationen seien die thermische Anlage von CWP stillgelegt und die Bauarbeiten an der neuen Extraktionsanlage eingestellt worden. CFB ist der Auffassung, dass die Baukosten für die neue Anlage zu niedrig kalkuliert wurden und CWP nicht über das erforderliche Know-how für ein neues Verfahren zur Herstellung von Phosphorsäure verfügt. Im Übrigen gebe CWP nicht an, auf welche Weise die bei dem neuen Herstellungsverfahren anfallenden toxischen Koppelprodukte weiterverarbeitet werden sollen. Darüber hinaus stellt CWP fest, dass TI erfolgreich Phosphorsäure im thermischen Verfahren herstellt, was widerlegt, dass eine Änderung des Herstellungsprozesses notwendig ist, um die Rentabilität von CWP wiederherzustellen. CFB bezweifelt, dass es Probleme bei der Versorgung mit elementarem Phosphor gab. Die Herstellung von Phosphorsäure in der neuen Anlage würde also die Vorfinanzierungskosten nicht reduzieren.

(74) In its letter of 20 August 2001, Chemische Fabrik Budenheim A. Oetker (CFB) expressed doubts as to the viability of the restructuring plan. It claimed that the construction of the new extraction installation was impracticable at such low cost and over the short period envisaged by CWP. It stated that this had been confirmed subsequently since, according to market information, CWP’s thermal installation had been shut down and the construction of the new extraction installation interrupted. In its view, the calculation of the construction costs of the new installation was too low and CWP did not have the required know-how for a new process to produce phosphoric acid. Besides, CWP did not indicate how the noxious by-products of this new process were to be treated. CFB also noted that TI successfully produced phosphoric acid using the thermal process, refuting the claim that a change in the production process was necessary for CWP to restore its profitability. It doubted that there were problems in obtaining elemental phosphorus. The production of phosphoric acid in the new installation would not, therefore, reduce advance financing costs.
