Grundlage für die Organspende in Deutschland ist das Transplantationsgesetz (TPG) normiert im BGBl I (Bundesgesetzblatt Teil 1). Erlassen wurde das TPG 1997 und zuletzt geändert 2009. Es umfasst 26 Paragraphen, welche u.a. die Spende, Entnahme und Übertragung von Organen regelt, die postmortal oder lebend gespendet werden. Ein Ziel dieses Gesetzes ist es, potentiellen SpenderInnen und EmpfängerInnen von Organen Rechtssicherheit zu gewährleisten und die Bevölkerung rund um das Thema Organtransplantation aufzuklären. Basis for organ donation in Germany the transplant law (TPG) is normalized in the Federal Law Gazette I (Federal Law Gazette Part 1). Adopt the TPG was amended in 1997 and most recently 2009. It includes 26 paragraphs, which among other things controls the donation, removal and transfer of organs that gross or alive will be donated. A goal of this law is to guarantee legal certainty for potential donors and recipients of organs and to enlighten the population around the subject of organ transplantation. The removal of organs and tissues for dead donors is regulated in section 2 of TPGes. Death criterion is the brain-stem death
