I think that the application of the human rights clause can be dealt with both adjectivally and substantially.

But there are other problems with the tribunal’s reliance on this passage. In a footnote the judges noted, without comment, that Nahimana had objected to the formulation ‘‘. . . known as the Inyenzi-Inkotanyi, Tutsis’’, on the footing that in the original utterance the last word was, according to Nahimana, rendered adjectivally, and thus the translation should have been ‘‘. . . known as the Tutsi Inyenzi-Inkotanyi’’. This adds significantly to the overall ambiguity of the passage. We might assume that the defendant’s objection was overruled, but if so, it is not clear on what basis this was done (none of the judges had any knowledge of Kinyarwanda), or why the objection was allowed to stand in a footnote to the translated text.

 angenommen wird, dass der Einwand der Beklagten aufgehoben wurde, aber wenn ja, es
 ist nicht klar, auf welcher Grundlage Dies geschah (keiner der Richter hatte jeder
 Kenntnis der Kinyarwanda), oder warum der Einwand durfte
 stehen Sie in einer Fußnote zu den übersetzten Text.
