Please be informed that tax authorities issued the revised decree regarding the application of the RETT tax group relief according to sec 6a RETT-Act. From our point of view the (revised) decree is (still) not in line with the tax law. The decree provides for a tightened and reduced application of the RETT tax group relief. For the case at hand it states that the relief would not be applicable at all. However, it also states that as far as the former decree provides for an application this result would remain. For the pending case this would mean a RETT group relief of 5.1% which was already assessed.

Beachten Sie aber bitte, dass die Steuerbehörden die revidierte Verordnung über die Anwendung der Steuer RETT group relief ausgestellt gemäß § 6a RETT-Act. Aus unserer Sicht ist die (überarbeitete) Erlass ist (noch) nicht im Einklang mit dem Steuerrecht. Das Dekret sieht eine gestrafft und reduziert Anwendung des RETT Steuergruppe Erleichterung. Für den vorliegenden Fall heißt es, dass das Relief wäre nicht überhaupt anwendbar. Allerdings ist es auch, dass so weit wie der frühere Dekret sieht für eine Anwendung dieses Ergebnis bleiben würde. Für den anhängigen Fall würde dies bedeuten, eine RETT group relief von 5,1%, die bereits beurteilt wurde.
