(62) Therefore, the Dutch authorities assert that the preliminary doubts of the Commission regarding "concomitance" and "identical terms and conditions" originating from the pre-investments of the Amsterdam municipality are properly addressed by the above-mentioned explanations provided and by the reimbursement of the relevant pre-financed costs to GNA.

It also points out that the principle of concomitance has not been complied with in so far as the French authorities granted the credit line and announced their participation in the recapitalisation prior to the announcement of the Ambition 2005 plan and prior to the firm commitment of the investors.

(99) In summation, in view of this analysis and of the constant practice of the Commission and the case law of the Court as regards the qualification of State participation in capital increases together with private investors, looked at on its own merits and independent of the other restructuring measures, the capital increase planned for mid-2007 amounts to a concomitant participation of public and private shareholders and therefore the participation of the State would not amount to State aid if the conditions set out above, relating to the fact that the capital increase will be underwritten by a commercial investment bank in a way ensuring effective concomitance of public and private subscription and to the ratio of public to private ownership, are complied with.

(99) In Anbetracht dieser Untersuchung sowie der ständigen Vorgehensweise der Kommission und des Fallrechts des Gerichtshofes hinsichtlich der Beurteilung staatlicher Beteiligungen an Kapitalerhöhungen gemeinsam mit privaten Anlegern ist die für Mitte 2007 geplante Kapitalerhöhung alles in allem - für sich genommen und unabhängig von den anderen Umstrukturierungsmaßnahmen - als gleichzeitige Beteiligung öffentlicher und privater Aktionäre zu werten.
