(17) According to Italy, training institutions funding was intended to remove the correspondent organisation shortcomings of the beneficiaries, possibly susceptible to undermine the success of the certification process. As a matter of fact, only the certificated training agencies have been, in principle, allowed to implement training activities financed by public resources from July 2003 onward.(18) On the other hand, the training institutions were already free to supply "private" training -which is to say market training services on a competitive basis-since 1997, further to the evolution of the relevant legal national framework (namely the "pacchetto Treu"; national law 144/99 and the State-Regions agreement of March 2000) and in several cases indeed implemented it.

(17) Den Angaben Italiens zufolge sollten mit der Förderung der Bildungseinrichtungen die organisatorischen Mängel der Begünstigten behoben werden, da diese den Erfolg des Anerkennungsprozesses zu gefährden drohten. Tatsächlich sind seit Juli 2003 grundsätzlich allein anerkannte Bildungseinrichtungen berechtigt, mit öffentlichen Mitteln finanzierte Bildungsmaßnahmen durchzuführen.(18) Des Weiteren konnten Bildungseinrichtungen bereits seit der Ausarbeitung des einschlägigen nationalen Rechtsrahmens im Jahr 1997 eine Art "privater" Bildungsdienste anbieten – d. h. marktbestimmte Bildungsdienste unter Wettbewerbsbedingungen – und haben auch in zahlreichen Fällen von dieser Möglichkeit Gebrauch gemacht. Der genannte Rechtsrahmen umfasst insbesondere das so genannte "Pacchetto Treu", das Gesetz Nr. 144 vom 17. Mai 1999 über Maßnahmen im Investitionsbereich, die Beauftragung der Regierung zur Neuordnung der Anreize zur Beschäftigung und der Rechtsvorschriften zur Regelung der INAIL sowie über Bestimmungen zur Neuordnung der Versicherungsträger sowie die Vereinbarung zwischen dem Staat und den Regionen vom März 2000.
