FINAL PROVISIONS AND COURT OF JURISDICTION

SCHLUSSBESTIMMUNGEN UND GERICHTSSTAND

The court of jurisdiction for natural persons is Zurich.

Der Gerichtsstand für natürliche Personen ist Zürich.

This agreement shall be subject to, interpreted, construed and performed exclusive in accordance with German law. Any other rights, such as private international law or other regulations about the applicable law shall apply - as much as possible - to this agreement. The court of jurisdiction for all cases arising out of or in relation with present agreement is the registered office of GEA Food Solutions.

Diese Vereinbarung unterliegt, interpretiert, ausgelegt und durchgeführt exklusiv in Übereinstimmung mit deutschem Recht. Alle sonstigen Rechte, wie des internationalen Privatrechts oder andere Vorschriften über das anwendbare Recht gelten - so weit wie möglich - zu dieser Vereinbarung. Der Gerichtsstand für alle Fälle, die sich aus oder im Zusammenhang mit dieser Vereinbarung ist der Sitz der GEA Food Solutions.

This requirement is not fulfilled, because the place of jurisdiction agreement referred to in No. 13, Item 7 of the Policy Terms grants no legar power of court appeal to the policyholder, the insured parties or the beneficiaries, which is not granted to them pursuant to Article 9 of the EuGVVO, but is rather evidenced by the wording "for all disputes" which referes exclusively and with final effect to the court of jurisdiction relevant to the place of residence of the policyholder.

Daran fehlt es, weil die Gerichtsstandsvereinbarung in Nr. 13 Punkt 7 der Policenbedingungen dem Versicherungsnehmer sowie Versicherten und Begünstigten keine Befugnis einräumt, ein Gericht anzurufen, das ihm nicht bereits nach Art. 9 EuGVVO offen steht, sondern ihn vielmehr ausweislich des Wortlauts “für alle Streitigkeiten” ausschließlich und abschließend auf das für den Wohnsitz des Versicherungsnehmers zuständige Gericht verweist.
