We thank you for your message of January 16, 2013, with the results of your investigations in respect to the pharmacological activity of deuterated DOPA derivatives. We have noted from the results that a combination or mixture of 10% alpha,beta-D2-L-DOPA and 90% alpha,beta,beta-D3-L-DOPA is as active as alpha,beta-D2-L-DOPA but exhibits less side effects like dyskinesia. We believe that this finding has to be considered as a surprising effect that might establish an inventive step as necessary for the grant of a patent. The other necessary prerequisite for granting a patent is the novelty of such a combination or mixture. From our knowledge of relevant state of the art that we have gathered during the prosecution of protecting the single components of the combination or mixture as given above we believe that the combination may be considered as novel.

Wir haben aus den Ergebnissen festgestellt, dass eine Kombination bzw. Mischung aus 10% alpha, beta-D2-L-DOPA-und 90% alpha, beta, beta-D3-L-DOPA so aktiv wie alpha, beta-D2-L-DOPA ist zeigt aber weniger Nebenwirkungen wie Dyskinesien. Wir glauben, dass dieser Befund als einem überraschenden Effekt, auf einer erfinderischen Tätigkeit als notwendig für die Erteilung eines Patents zu etablieren könnten berücksichtigt werden muss. Der andere notwendige Voraussetzung für die Erteilung eines Patents ist die Neuheit eines solchen Kombination oder Mischung. Aus unserer Kenntnis der einschlägigen Stand der Technik, die wir während der Verfolgung des Schutzes der einzelnen Komponenten der Kombination oder Mischung wie oben wir gegeben gesammelt glauben, dass die Kombination neuartiger Betracht gezogen werden.
