In November 2003 the Commission presented a proposal for a regulation which seeks first to impose an obligation on the Member States to stamp such travel documents systematically; secondly, to lay down the conditions in which the absence of an entry stamp may constitute evidence that the individual has overstayed in the Member State 's territory; and thirdly to ensure that the checks on individuals at external borders are only relaxed in exceptional and unforeseen circumstances.

1.2. Verification of the applicant's identity and verification as to whether an alert has been issued on the applicant in the Schengen Information System (SIS) for the purpose of refusing entry or verification as to whether the applicant poses any other threat (to security) which would constitute grounds for refusal to issue the visa or whether, from an immigration point of view, the applicant poses a risk in that on a previous visit he/she overstayed the authorised length of stay.

1.2. Überprüfung der Identität des Antragstellers; weiterhin ist zu prüfen, ob er im Schengener Informationssystem "SIS" zur Einreiseverweigerung ausgeschrieben ist, ob sonstige (Sicherheits)risiken vorliegen, die einer Visumerteilung entgegenstehen; darüber hinaus ist mit Blick auf unerlaubte Einwanderung zu prüfen, ob vorherige Aufenthaltsfristen überschritten wurden.
