Where the ultimate parent insurance or reinsurance undertaking or insurance holding company which has its head office in the Community, referred to in paragraph 1, is a subsidiary undertaking of an undertaking which is subject to supplementary supervision in accordance with Article 5(2) of Directive 2002/87/EC, the group supervisor may, after consulting the other supervisory authorities concerned, decide not to carry out at the level of that ultimate parent undertaking the supervision of risk concentration referred to in Article 244, the supervision of intra-group transactions referred to in Article 245, or both.

(2) Ist das in Absatz 1 genannte oberste beteiligte Mutterversicherungs- oder Rückversicherungsunternehmen oder die dort genannte oberste Versicherungsholdinggesellschaft mit Sitz in der Gemeinschaft Tochterunternehmen eines Unternehmens, das nach Artikel 5 Absatz 2 der Richtlinie 2002/87/EG einer zusätzlichen Beaufsichtigung unterliegt, so kann die für die Gruppenaufsicht zuständige Behörde nach Konsultation der anderen betroffenen Aufsichtsbehörden beschließen, auf Ebene dieses obersten Mutterunternehmens von der Überwachung der Risikokonzentration gemäß Artikel 244, der Überwachung der gruppeninternen Transaktionen gemäß Artikel 245 oder von beidem abzusehen.
