Sowohl zur SUP-Richtlinie , der Habitat-Richtlinie als auch zur Aarhus-Convention entschied der EuGH in seinem Urteil vom 16. Februar 2012 zu C-182/10 Marie-Noelle Solvay u.a. / Région Wallone im Zusammenhang mit den Bauarbeiten an einem Flughafen und an einer Eisenbahnstrecke, dass der Leitfaden zum Aarhus Übereinkommen nicht bindend ist und nur den Bestimmungen der Konvention selbst normativ bindende Wirkung zukommt.
