Where, following the enquiries carried out in accordance with the procedures established in Annex IV, the Commission notes that the information in its possession constitutes proof that products orginating in a supplier country listed in Annex V and subject to the quantitative limits referred to in Article 2 or introduced under Article 9 have been transhipped, re-routed or otherwise imported into the Community through circumvention of such quantitative limits and that there is a need for the necessary adjustments to be made, it shall request that consultations be opened, in accordance with the procedure described in Article 16, so that agreement may be reached on an equivalent adjustment of the corresponding quantitative limits.

Stellt die Kommission aufgrund von nach den Verfahren in Anhang IV durchgeführten Ermittlungen fest, daß die ihr zur Verfügung stehenden Informationen beweisen, daß Waren mit Ursprung in einem in Anhang V aufgeführten Lieferland, für die eine Hoechstmenge gemaeß Artikel 2 gilt oder gemaeß Artikel 9 festgesetzt worden ist, durch Umladung, Umleitung oder auf andere Weise unter Umgehung dieser Hoechstmenge in die Gemeinschaft eingeführt worden sind und daß die erforderlichen Anpassungen vorgenommen werden müssen, so ersucht sie nach dem Verfahren des Artikels 16 um die Eroeffnung von Konsultationen, um zu einer Vereinbarung über eine gleichwertige Anpassung der entsprechenden Hoechstmenge zu gelangen.
