The President of the Office shall provide for the publication of the information referred to in Article 89, prior to the remittal of the case.

After the remittal of the case, the chairman of the Board of Appeal shall, without delay, summon the parties to the appeal proceedings to oral proceedings as provided for in Article 77 of the basic Regulation and shall draw their attention to the contents of Article 59(2) of this Regulation.

(1) Nach Überweisung des Falls werden die am Beschwerdeverfahren Beteiligten vom Vorsitzenden der Beschwerdekammer unter Hinweis auf Artikel 59 Absatz 2 unverzüglich zu einer mündlichen Verhandlung nach Artikel 77 der Grundverordnung geladen.

Prior to the remittal of the case, the body of the Office referred to in Article 70(1) of the basic Regulation shall promptly transmit a copy of the documents received by a party to the appeal proceedings to the other parties to the appeal proceedings.

(2) Vor Überweisung des Falls übermittelt die Stelle des Amts im Sinne von Artikel 70 Absatz 1 der Grundverordnung den am Beschwerdeverfahren Beteiligten umgehend eine Kopie der bei ihr eingegangenen Schriftstücke der anderen Verfahrensbeteiligten.

Were it otherwise, i.e. were it open to the parties to challenge these findings and for the Opposition Division to overturn them during subsequent proceedings on remittal for the adaptation of the description, this would render the decision as a whole, including the order, nugatory and futile and would thus, in effect, destroy its binding nature.

Wäre es anders, könnten also diese Feststellungen bei Zurückverweisung der Sache zur Anpassung der Beschreibung in einem nachfolgenden Verfahren von den Beteiligten in Frage gestellt und von der Einspruchsabteilung aufgehoben werden, so würde die Entscheidung als Ganzes einschließlich der Entscheidungsformel hinfällig und wäre damit de facto ihrer Rechtsverbindlichkeit beraubt.

The remaining two-thirds of the appeal fee shall be due, upon request of the Office, within one month after remittal of the case by the relevant body of the Office of the Board of Appeal.

Die restlichen zwei Drittel der Beschwerdegebühr sind auf Aufforderung des Amtes innerhalb eines Monats zu zahlen, nachdem die zuständige Stelle des Amtes den Fall der Beschwerdekammer vorgelegt hat.
